1. Overview

Distinctly Marketing, Inc. ("Distinct.ly," "we," "us," or "our") operates the DARG consumer intelligence platform and the distinct.ly website. This Privacy Policy describes how we collect, use, and protect information when you use our services.

2. Information We Collect

Account Information: When you create an account or contact us, we collect your name, email address, company name, and job title.

Usage Data: We collect information about how you interact with our platform, including API usage, feature access, and session data.

Client Data: Data you submit to DARG for analysis is processed in isolated environments. All personally identifiable information (PII) is scrubbed on ingestion. Raw data is deleted after processing — only anonymized, aggregated insights are retained.

Proprietary Dataset: DARG's 165M+ behavioral profile dataset is built from publicly available, ethically sourced data and is never derived from client-submitted data.

3. How We Use Information

We use collected information to:

  • Provide, maintain, and improve our platform and services
  • Generate behavioral intelligence insights for your account
  • Communicate with you about your account, updates, and support
  • Ensure the security and integrity of our platform
  • Comply with legal obligations

We do not sell personal information. We do not use your data to train models that serve other clients.

4. Data Isolation

DARG operates a zero-crossover architecture. Each client's data is processed and stored in a completely isolated environment. Your data is never commingled with, accessible to, or used to benefit any other client.

5. Data Security

We implement industry-standard security measures including encryption at rest (AES-256) and in transit (TLS 1.3), scoped API key authentication, audit logging, and access controls.

6. Data Retention

Client-submitted raw data is deleted after processing. Anonymized insights are retained for the duration of your account. Account information is retained as long as your account is active. Upon account termination, all associated data is deleted within 30 days.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access, correct, or delete your personal information
  • Object to or restrict processing of your data
  • Request data portability
  • Withdraw consent where processing is based on consent

To exercise these rights, contact us at privacy@distinctlymktg.com.

8. GDPR & CCPA

DARG is GDPR and CCPA compliant. For EU residents, Distinctly Marketing acts as a data processor for client-submitted data and a data controller for account information. California residents may exercise rights under the CCPA by contacting us at the address below.
